These terms and conditions govern the use of Gentle Oddities illustrations (including graphic elements) by teachers, parents, and educational product creators for personal and commercial purposes. By downloading or using these illustrations, you agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use the illustrations.

Please note that these terms of use apply to Gentle Oddities illustrations only and do not apply to any other content or products sold by Gentle Oddities or by other sellers.

These terms of use may be modified at any time. Please review the terms of use periodically to ensure compliance with any changes.

 

Intellectual Property Rights

This is a single user license agreement. By using Gentle Oddities illustrations, you acknowledge and agree that you do not acquire any ownership in the illustrations. You acknowledge and agree that you have acquired a license to use the illustrations with limited use rights expressly granted in these terms of use.

To avoid any misunderstandings about the permitted uses of Gentle Oddities illustrations, please contact me before making a purchase if you have any doubt.

If you become aware of any infringement or potential infringement of the intellectual property rights in Gentle Oddities illustrations, please contact me immediately.

 

Commercial Use

Not allowed for commercial use

❌ Sell on any kind of e-book store.

❌ Create a product for a publisher or manufacturer.

❌ Use Gentle Oddities illustrations in apps, books, magazines or e-books.

❌ Create coloring pages of any kind, including color by number.

❌ Use Gentle Oddities illustrations to create and sell/distribute your own pieces of illustrations/cliparts.

❌ Create products for others to use in the creation of their commercial products. Your product must be sold for direct classroom or homeschool use.

❌ Altering images: cutting up, taking out facial features, etc.

❌ Any non-educational use, including but not limited to printing on T-shirts, mugs, etc.

❌ Branding of any sort, including logo design. TPT banners or flyers using Gentle Oddities illustrations are not allowed. You can however use images of your products containing Gentle Oddities illustrations in TPT banners or flyers.

❌ Not securing Gentle Oddities illustrations in your product. Images can be easily extracted from files like PDFs or Google Slides. Click here to visit my husband’s website and learn how to prevent my illustrations and your own illustrations from being extracted.

❌ Sharing, trading, redistributing or selling Gentle Oddities illustrations.

❌ Post, use or display Gentle Oddities original illustrations on social networks or on any website (including your blog). Only display products containing the illustrations, not the illustrations alone. Do not post Gentle Oddities illustrations on the internet in any format. They are not web graphics.

❌ Making items with Gentle Oddities illustrations as the primary component, including printable stationery that is not part of a lesson or specific activity. Are not allowed: plain graphics, bulletin board elements, printable graphic puppets, gift tags, bingo, flash cards, teacher postcards etc.

❌ Create defamatory, offensive, or illegal content with Gentle Oddities illustrations.

❌ Use in a manner that suggests or implies endorsement, affiliation, or sponsorship by Gentle Oddities.

Allowed for commercial use

✅ Creating products with educational content. The illustrations must accompany some form of text such as numbers, letters, words, or sentences on any page you create with the illustrations.

✅ Sell printable products containing Gentle Oddities illustrations on Teachers Pay Teachers, on similar teaching marketplaces, and in your own store on your website or blog, with appropriate credit given at least inside the product.
Examples: educational worksheets, center activities, progress monitoring forms, specific classroom certificates. Student writing papers may be created if it is incorporated into a specific lesson or larger product.

✅ Sell Boomcards and Easel activities containing Gentle Oddities illustrations with appropriate credit given. No need to secure the illustrations as these platforms don’t allow extraction of images. No need for an additional license.

✅ Sell Google Slides, Powerpoints, and other digital formats containing Gentle Oddities illustrations with appropriate credit given and as long as the illustrations are secured to prevent image theft. ✅ Video lessons with appropriate credit given. No need for an additional license.

✅ Post, use or display images of your product containing Gentle Oddities illustrations on your website (including blog) and social networks, but never the illustrations alone.

 

Personal Use

Not allowed for personal use

❌ Post Gentle Oddities illustrations on the internet in any format. They are not web graphics.

❌ Distribute or share the illustrations.

❌ Share items not allowed in the commercial use restrictions.

❌ Create diffamatory, offensive, or illegal content with Gentle Oddities illustrations.

❌ Use in a manner that suggests or implies endorsement, affiliation, or sponsorship by Gentle Oddities.

Allowed for personal use

✅ Use Gentle Oddities illustrations for anything within your own classroom or home, as long as you follow the previously mentioned personal use restrictions.

✅ Share items allowed by the commercial use restrictions, with appropriate credits given.

 

Portraits of public figures

Some illustrations may include portraits of public figures. These portraits are strictly intended for educational use only and do not imply endorsement or affiliation by the individuals depicted.

You are strictly prohibited from using any portrait of a public figure for any purpose that may be defamatory, offensive, or illegal. Such uses may include, but are not limited to, uses in connection with hate speech, false information, or any form of expression that is unlawful or that promotes illegal activity.

 

Attribution Requirements

Any use of Gentle Oddities illustrations in a product requires proper attribution. The attribution must be clearly visible in the product and state “Illustration by Gentle Oddities” along with a link to my Teachers Pay Teachers store:

How to give credit:

 

• • In a traditional resource, provide a clickable link or hyperlinked button to my TPT store on the credits page.

• • In digital resources like Google Docs/Slides/Sheets, PowerPoint, Smartboard, or Boom Cards, credit should be given as a clickable link or hyperlinked button within the product documents or on the product pages.

• • For videos, credit can be given in the final image of the video or in the product documents that accompany the video resource.

• • For heavily graphic based resources, use illustrations or text to distinguish the artist on the credits page (i.e. “Portrait illustrations provided by…”).

• • For digital courses, credit Gentle Oddities as noted above for videos. If you want to feature my work as part of your course documents, please credit as a “traditional” or “digital” resource.

 

Termination and Remedies

Gentle Oddities reserves the right to terminate these Terms of Use and/or your access to the illustrations at any time without notice in the event of any breach of these Terms of Use by you.

In the event of any termination of these Terms of Use, you must immediately cease all use of the illustrations and destroy any copies of the illustrations in your possession.
